1. Acceptance of Terms

1.1 Agreement to Terms

By accessing or using the CashbackPro website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

1.2 Legal Capacity

By using the Service, you represent and warrant that:

You have the legal capacity to enter into a binding contract
You are not prohibited from using the Service under applicable laws
All information you provide is accurate and complete

2. Definitions

"Account": Your registered user account on the Service. "Affiliate Partner": Third-party merchants (e.g., AliExpress, eBay) with whom we have partnership agreements. "Cashback": Commission earned by users through qualifying purchases made via Affiliate Links. "Affiliate Link": A unique tracking link provided by CashbackPro that redirects to an Affiliate Partner's website. "Order": A purchase made through an Affiliate Link. "Pending Cashback": Cashback that has been tracked but not yet confirmed by the Affiliate Partner. "Confirmed Cashback": Cashback that has been validated and is available for withdrawal. "Rejected Cashback": Cashback that has been declined by the Affiliate Partner. "Withdrawal": The process of transferring Confirmed Cashback to your payment account. "KYC": Know Your Customer - identity verification procedures. "AML": Anti-Money Laundering compliance measures.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

Exception: Users aged 16-17 in the European Economic Area (EEA) may use the Service with verifiable parental or guardian consent.

3.2 Geographic Restrictions

The Service is available globally, except in jurisdictions where prohibited by law. We reserve the right to restrict access in certain regions.

Currently Restricted: North Korea, Iran, Syria, Cuba (due to international sanctions).

3.3 Account Registration

To use the Service, you must:

Provide accurate, current, and complete information
Maintain and update your information
Keep your password secure and confidential
Notify us immediately of any unauthorized access

3.4 One Account Per Person

You may only create one account per person. Multiple accounts created by the same individual may be suspended or terminated without notice.

3.5 Account Ownership

Accounts are non-transferable. You may not:

Sell, trade, or transfer your account
Share your account credentials
Allow others to use your account

4. How CashbackPro Works

4.1 Service Overview

CashbackPro is an affiliate marketing platform. We earn commissions from Affiliate Partners when users make purchases through our Affiliate Links. We share a portion of this commission with you as Cashback.

4.2 Cashback Process

Step 1: Click You click an Affiliate Link on our Service. Step 2: Purchase You complete a purchase on the Affiliate Partner's website within the same browsing session. Step 3: Tracking The Affiliate Partner notifies us of your purchase (typically within 24-72 hours). Step 4: Pending Cashback appears in your account as "Pending" (status: Payment Completed). Step 5: Confirmation After the Affiliate Partner's return period (typically 14-90 days), Cashback moves to "Confirmed" (status: Completed Settlement). Step 6: Withdrawal You can withdraw Confirmed Cashback to your payment account.

4.3 No Guarantee

Cashback is not guaranteed. It depends on:

Affiliate Partner confirmation
Compliance with Affiliate Partner terms
Proper tracking (cookies, device fingerprints)
Order validity (no returns, cancellations, or fraud)

5. Cashback Rules and Conditions

5.1 Qualifying Purchases

To earn Cashback, you must:

Click an Affiliate Link on our Service
Complete the purchase in the same browsing session
Not use ad blockers or privacy tools that block tracking
Not use coupon codes from unauthorized sources
Complete the purchase within the Affiliate Partner's tracking window (typically 24 hours)

5.2 Non-Qualifying Purchases

Cashback is not available for:

Purchases made without clicking our Affiliate Link
Orders canceled or returned
Fraudulent or suspicious transactions
Purchases using unauthorized coupons
Gift card purchases (unless explicitly stated)
Purchases violating Affiliate Partner terms

5.3 Cashback Rates

Cashback rates vary by:

User tier (Standard, Silver, Gold)

Rates are subject to change without notice. The rate displayed at the time of click applies to that transaction.

5.4 Cashback Statuses

Pending (Payment Completed):

Order tracked but not confirmed
Typical duration: 14-90 days
May be rejected if order is canceled or returned

Confirmed (Completed Settlement):

Order validated by Affiliate Partner
Available for withdrawal
Cannot be reversed (except in cases of fraud)

Rejected (Invalid):

Order declined by Affiliate Partner
Common reasons: return, cancellation, fraud, tracking failure

5.5 Cashback Expiration

Pending Cashback expires if not confirmed within 90 days of purchase. Confirmed Cashback does not expire as long as your account remains active.

5.6 Minimum Withdrawal Amount

The minimum withdrawal amount is:

PayPal: $5 USD
Stripe: $10 USD
Cryptocurrency: $20 USD equivalent

6. Withdrawals and Payments

6.1 Payment Methods

We support the following withdrawal methods:

PayPal (email-based)
Stripe (bank transfer, debit card)
Cryptocurrency (Bitcoin, Ethereum, USDT)

6.2 Processing Times

Selfie photograph

Failure to provide verification may result in withdrawal delays or account suspension.

6.4 Payment Errors

If a payment is sent to an incorrect account due to your error:

We are not responsible for recovery
We may attempt to assist but cannot guarantee success
Fees for recovery attempts may apply

6.5 Tax Obligations

You are solely responsible for reporting and paying taxes on Cashback earnings in your jurisdiction.

We may issue tax forms (e.g., 1099-MISC for US users) if required by law.

7. User Obligations and Prohibited Conduct

7.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

7.2 Prohibited Activities

You must not:

Fraud and Abuse:

Create fake orders or returns
Use stolen credit cards or payment methods
Engage in "cashback farming" or similar schemes
Manipulate tracking systems

Multiple Accounts:

Create multiple accounts to earn duplicate Cashback
Use accounts of family members or friends without permission

Automation:

Use bots, scripts, or automated tools
Scrape or harvest data from the Service
Interfere with Service functionality

Circumvention:

Disable cookies or tracking technologies
Use VPNs or proxies to manipulate location
Clear cookies between click and purchase

Misrepresentation:

Provide false information during registration
Impersonate another person or entity
Misrepresent your relationship with any person or entity

Illegal Activity:

Use the Service for money laundering
Purchase illegal goods or services
Violate any applicable laws or regulations

7.3 Consequences

Violation of these prohibitions may result in:

Immediate account suspension or termination
Forfeiture of Pending and Confirmed Cashback
Legal action and liability for damages
Reporting to law enforcement

8. Account Suspension and Termination

8.1 Suspension by CashbackPro

We may suspend your account if:

We suspect fraudulent activity
You violate these Terms
We require additional verification
We receive a legal request or court order

During suspension:

You cannot access your account
Withdrawals are blocked
Pending Cashback may be forfeited

8.2 Termination by CashbackPro

We may terminate your account if:

You repeatedly violate these Terms
We confirm fraudulent activity
You fail to respond to verification requests within 30 days
Required by law or regulatory authority

Upon termination:

Pending Cashback is forfeited
Confirmed Cashback may be paid out (at our discretion)
You are permanently banned from creating new accounts

8.3 Termination by User

You may close your account at any time by:

Following the account closure process

Upon closure:

Pending Cashback is forfeited
Confirmed Cashback must be withdrawn before closure
Personal data is handled per our Privacy Policy

8.4 Effect of Termination

Upon termination:

All licenses granted to you terminate immediately
You must cease all use of the Service
Provisions that by their nature should survive termination will survive

9. Intellectual Property Rights

9.1 Our Rights

The Service and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and data compilations) are owned by CashbackPro Ltd. or our licensors and are protected by:

Copyright laws
Trademark laws
Patent laws
Trade secret laws
Other intellectual property rights

9.2 Trademarks

"CashbackPro," our logo, and other marks are trademarks of CashbackPro Ltd. You may not use these marks without our prior written permission.

9.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the Service for personal, non-commercial purposes
View and print content for personal use

You may not:

Modify, copy, distribute, or create derivative works
Reverse engineer, decompile, or disassemble the Service
Remove or alter any copyright, trademark, or proprietary notices

9.4 User Content

If you submit content to the Service (e.g., reviews, feedback, suggestions):

You retain ownership of your content
You grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display your content
You represent that you have the right to grant this license

10. Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or completeness

10.2 No Guarantee of Cashback

WE DO NOT GUARANTEE:

That Cashback will be tracked or confirmed
That Affiliate Partners will honor commissions
That the Service will be uninterrupted or error-free
That defects will be corrected

10.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASHBACKPRO LTD. SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Business interruption
Personal injury or property damage

MAXIMUM LIABILITY: Our total liability to you for all claims arising from or related to the Service shall not exceed the greater of:

$100 USD, or
The amount of Confirmed Cashback in your account at the time of the claim

10.4 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10.5 Third-Party Liability

We are not responsible for:

Actions or omissions of Affiliate Partners
Payment processor errors or delays
Third-party website content or availability
Fraud or security breaches by third parties

11. Indemnification

You agree to indemnify, defend, and hold harmless CashbackPro Ltd., its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights
Your violation of any applicable laws or regulations
Fraudulent or illegal activity on your account

This indemnification obligation survives termination of these Terms.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of:

Israel (for users worldwide, unless otherwise specified)
European Union law (for EU residents, where applicable)
California law (for California residents, where applicable)

12.2 Jurisdiction and Venue

For Non-EU Users: Any disputes shall be resolved exclusively in the courts of Tel Aviv, Israel. You consent to the personal jurisdiction of these courts. For EU Users: You may bring claims in the courts of your country of residence or in Israel. For California Users: Disputes may be resolved in California courts or Tel Aviv courts, at your option.

12.3 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution. We will attempt to resolve disputes within 30 days.

12.4 Arbitration (Optional)

If informal resolution fails, either party may elect binding arbitration under:

International: ICC Arbitration Rules (International Chamber of Commerce)
Israel: Israel Arbitration Law
EU: Mediation as per EU ADR Directive

Arbitration Location: Tel Aviv, Israel (or online) Language: English Costs: Each party bears its own costs unless otherwise awarded

12.5 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. You waive any right to participate in class actions, class arbitrations, or representative actions. Exception: This waiver does not apply where prohibited by law (e.g., certain EU jurisdictions).

12.6 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court.

13. Modifications to Terms

13.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be made to:

Reflect changes in law or regulation
Implement new features or services
Improve clarity or address ambiguities
Respond to security or fraud concerns

13.2 Notice of Changes

Material Changes:

Email notification to registered users (30 days' notice)
Prominent notice on the Service
Updated "Last Updated" date

Non-Material Changes:

Updated "Last Updated" date
Notice on the Service

13.3 Acceptance of Changes

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

If you do not agree to the changes, you must stop using the Service and may close your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and CashbackPro Ltd. regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

Acts of God (earthquakes, floods, fires)
War, terrorism, or civil unrest
Government actions or regulations
Internet or telecommunications failures
Cyber attacks or data breaches

14.6 Language

These Terms are drafted in English. Translations may be provided for convenience, but the English version prevails in case of conflict.

14.7 Headings

Section headings are for convenience only and do not affect interpretation.

14.8 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to:
